General terms of sale and use of SelfTronic.com

1. Introduction
The present general terms (indicated hereafter " General terms "), govern the contractual relations between any purchaser on the selftronic.com site and extensions .com /fr, .com /it, .com /lu, .com /es, .com /be, .com /ch, etc, stated but non restrictive extensions (hereafter appointed the “Purchaser” or "You") and selftronic.com belonging to the company SelfTronic SPRL, located in Belgium, 1620 Drogenbos and registered under the number 0897 533 674 (hereafter indicated "SelfTronic"). These general terms of sale are the only applicable ones and replace all other conditions, except preliminary, express and written exemption. Consequently, the fact for any person of ordering an offered product on Internet site selftronic.com carries fully acceptance of these general terms of sale whose Purchaser admits having taken knowledge before the order SelfTronic reserves the right to modify the present general terms at any moment.

2. Order

Any order supposes adhesion without restriction nor reserve on the present general terms.

3. Product Information
SelfTronic gives information and essential characteristics of the products with technical descriptions and photographs illustrating the products which generally emanate from its partners, suppliers and manufacturers within the limit of the technique by as well as possible respecting the best standards of the market.
All the accessories contained in the bundles sold by SelfTronic are compatible accessories of marks and not of the marks of manufacturers

4. Price
SelfTronic reserves the right to modify its prices constantly, but is committed applying going rates at the time of the recording of the order.
The selling prices indicated on Website selftronic.com are in euros tax all inclusive. They do not include the forwarding costs invoiced in supplement of the price of the bought products. The forwarding costs will be indicated before the recording of the order by the Purchaser. As information, the prices which appear in euros on the Website can also appear in the currency of the country of forwarding. The price to be paid is in euros and is systematically indicated clearly before any confirmation of order.
SelfTronic reserves the right to modify its prices at any moment, but is committed applying going tariffs at the moment of the recording of the order.

5. Availability
Our offers of products are proposed within the limit of stocks available In the case of unavailability of one or more products after placing of the order, the Purchaser is as soon as possible informed by email. SelfTronic will be able in this case to provide products of quality and equivalent prices in replacement. The forwarding costs will be in this case with charge of SelfTronic. Failing this for SelfTronic to make use of this faculty, the Purchaser will be refunded without delay and at the latest in the thirty days of the payment of the paid amounts.

6. Delivery
The order validated by a payment before 10:00 will be treated in the course of the day. The order will be delivered to the address indicated by the Purchaser on the purchase order. In the event of absence during the delivery, a advice note is deposited by the forwarder inviting you to contact it to conclude a new delivery. The order validated by a payment Friday after 10:00 will be treated Monday. The products bought on Website SelfTronic are delivered everywhere in the world to the tariff of delivery indicated at the moment of your end of order in so far as a postal service or forwarder serves your address of delivery. The average delivery period observed for the articles available or in order are from 2 to 15 days in function of the country. We could not be responsible of the consequences due to a delay of delivery or a loss of parcels caused by a third with the contract of forwarding or by your fact or because  an unforeseeable cause. In any event, the ordered products will be delivered within a thirty days maximum delay as from the moment when the order is registered, subject to the complete payment of the price. In case non delivery to the expiry of this time, the Purchaser will have the possibility of cancelling its order. The sums paid by the Purchaser will be restored to him without delay, other than any other compensation.
In the event of non reception of a parcel within the period indicated, an investigation is carried out near the forwarder and can last up to 21 working days. If during this period, the product is found, it will be immediately forwarded to the place of delivery indicated in the purchase order. If it is not found at the conclusion of this period, SelfTronic will proceed to its expenses with a new forwarding of the products ordered by the Purchaser.

7. Quality or conformity problem
SelfTronic recommends to you to check well the conformity of the products as of reception of your order and  to register, if necessary, on the delivery order and in the form of handwritten reserves accompanied by your signature, any anomaly which you would have noted. In the event of delivery of a product not corresponding to the order (defective or not in conformity), the Purchaser must formulate his complaint by email, click here. within 7 day as from the signature of the delivery form. The return of the products will have to be made within 7 day as from the attribution of a number of return by the customer service of SelfTronic, return goods. The return of the products could be accepted only for the products in their original state, more precisely in their packaging including all the accessories and all the documents (information notes or advertising executives, directions for use, data sheets, etc). Any risk related to the return of the product is at charge of the Purchaser. In the event of real conformity, the Purchaser will have the choice between the repair or the replacement of the product except if the desired option involves an obviously disproportionate cost compared to another method.

8. Tax Reduction
A tax reduction is possible if you reside abroad (except EC). For that, it is necessary, once the received parcel, to send us a photocopy of the invoice, a document prouving the abroad residence. Once the form warned by the customs, the Purchaser must return it to us with a statement ofbanking identity (bank account number) and SelfTronic will proceed to the refunding of the tax by transfer on your bank account. For the refunding of the VAT, an cost of 3% will be applied for “expenses of treatment”.

9. Protected Payment
SelfTronic places at your disposal 7 variable methods of payment according to the countries: Checks SelfTronic Gifts, credit card (Visa, Mastercard, AMEX, CB, Dawn, ideal), PayPal , bank cheks, online banking (Crédit du Nord and ING Homepay) and credit on line via Cetelem. The safety of your payments is dealt with by Ogone via the security system " Secure Socket Layer " at the moment your coordinates are sent by Internet. For the payment by Checks SelfTronic Gifts, the  minimum purchase is 20 euros. In the case of a purchase whose amount is higher than the Checks Selftronic, the Purchaser  will have to supplement by payment by credit card. In the case of an order of a lower amount, the difference will not be refunded. In case of cancellation of order or stock shortage implying a refunding, this last could be done only by purchasing check validates on all our references for 12 months.

10. Period of reflexion
The Purchaser has a 7 days deadline as from the date of reception to send back, at his charge, the products ordered for refunding. The products must imperatively be sent back to SelfTronic in a perfect state of resale, in their state of origin (pacagking, accessories, notes advertising, notes…) duly sealed and accompanied by the invoice corresponding to the purchase. All contained information on numerical support (memory card, hard drive…) returned to SelfTronic by the Purchaser could not be recovered. The audio or video recordings as well as the software could be sent back only if you did not loosen them. The periods mentioned above begin as from the day of the reception of the order. In the event of refunding, - if the product is sent back to us in the seven days (postmark) as from its delivery on your premise, SelfTronic refunds you by credit transfer (except Checks SelfTronic). In case of appraise product within the framework of the right of retractation, SelfTronic will do the maximum to refund the Purchaser as soon as possible. This period will depend on the technical tests carried out, by the After Sales Service of the manufacturer, on your material, for 3 weeks maximum duration.
- In the event of return of the product between the eighth and the fifteenth day, refunding will be done in the form of cheque gift.

11. Return of goods
Any return of parcel must imperatively be sending back by the Post office (or another forwarder). The transport costs to Selftronic are at the charge of the customer except in the event of nonconformity of the product. For the period covered by the extensions of guarantee, the customer must send the product back to SelfTronic ASS of the company SelfTronic SPRL, Kuikenstraat 123-125, 1620 Drogenbos, Belgium.

12. Guarantee and after sales service (ASS)
All the sold products have:
- legal guarantee of conformity
- legal guarantee of the latent defects
- guarantee manufacturer of which the extent and the duration differ according to the products and the marks. The expenses of sending the product(s) are the charge of the customer.  Any return of product(s) to the above mentioned guarantee voucher must be the subject of a prior agreement of SelfTronic. For this purpose, the Purchaser will make contact by email, click here, with SelfTronic. After having filled the Return Goods Document, click here, and after agreement of SelfTronic (sending of a number of return), the Purchaser will be able to send back it(s) produc(s) within 7 working day starting from the communication of the number of return. No return will be accepted without prior approval of SelfTronic. The defective product must be sent back over in its original packaging, included the whole of the product and its accessories and be accompanied by the Return Goods Document. SelfTronic then engage to deal with possible repairs near the suppliers. Whatever the problem concerning your article, it is imperatively necessary to join with the defective product a copy of the invoice, the guarantee document (present in the box) and the document of return.
Caution: legal guarantee does not apply or applies only partially to repair of damage resulting from an external cause with the product (for example, accident, shock, lightning, a fluctuation of power…), or from a fault of the customer resulting for example of an employment or an installation non in conformity with the specifications of the manufacturer, or  abnormal use of the product.
The guarantees manufacturer of the products marketed by SelfTronic do not cover:
- the replacement of consumable (batteries, bulbs, fuses, wear of heads of recording or of reading…),
- the abnormal use or not in conformity of the products. We invite you in this respect consulting attentively the notice provided with the products,
- breakdowns related to the accessories (electric cable.),
- damage due to  intervention of a repairer not approved by SelfTronic,
- damage resulting of an external cause with the product (for example, accident, shock, lightning, fluctuation of power…),
- defects and their consequences related to the use not-in conformity with the use for the which product is intended (professional, collective use).
In all the cases, SelfTronic could not be held responsible in the event of refusal for the manufacturer  to apply its guarantee for the reasons above exposed.
In the event of not deal with of repair, the manufacturer will establish an estimate. General and administration expenses will be required by the manufacturer in the event of refusal to pay of this estimate. In case of agreement of the estimate, a credit transfer to the order of SelfTronic and corresponding to the amount of the estimate, will be to forward to us.

13. Litigation and responsability
This contract is subjected to the Belgian law. SelfTronic could not be responsible of non execution of the concluded contract, on one side in the case of major force, as defined by the courts and on another side in the case of fault of the customer or the unforeseeable fact of a third with the contract. We point out that it is carefull to proceed to the safeguard of the data contained in the bought products. SelfTronic could not be held responsible for the consequences resulting from the misuse of the market sold on the Website. Although our products have performances compatible with professional uses, SelfTronic does not have vocation to sell to professionals. For any interpretation of these general terms of sale in other languages it is the French text which prevails. In the event of litigation, the courts of Brussels are only qualified

14. Communication
All the opinions deposited by users of SELFTRONIC are supervised and moderated by the marketing team. Since the remarks ara against the law and ethics (abusive publicity, defamatory remarks, insults, comments out of context…), SelfTronic reserves the right to refuse or modify the concerned opinion

15. Protection of the personal data
The information communicated by the Purchaser being essential for the treatment and the sending of the orders, the establishment of the invoices and the contracts of guarantee, their absence involve the cancellation of your order. While being registered on the Website, the Purchaser commits himself providing us sincere and true information relating to him. The communication of false information is contrary with the present general terms and the conditions of' use reproduced on the Website. If you accepted it during your identification on the Site, promotional emails (emails), offers of destocking, exclusivenesses, good deals… will be sent to you. At any moment, you can ask not to receive emails of our side or a one of our partners. It is enough for you to click on the proposed link in the mails you receive. The person in charge of the treatment of your data is SelfTronic SPRL, Kuikenstraat 123-125, 1620 Drogenbos. All the data that you communicate to us are stored and intended for internal use and for the automated treatment within the framework of a responsible management of a company and customers, like the treatment of the orders and the management of the customers, the sending of our commercial offers like those of thirds selected by our care. We do not yield to thirds data which could carry reached to your private life. You have the right to access to your data and faculty to correct them. If you do not wish any more to receive postal mail of our side, it is enough to inform us in writing. If you have an objection against the fact of yielding your name and your address with thirds, warn us in writing. Our center of data processing is registered near the Commission on the Protection of the Private life (www.privacycommission.be).

16. Intellectual Property
The whole of the contents of Website SELFTRONIC (illustrations, texts, the wording, marks, images, videos) is the property of the Autors, its contracting or partners. Any reproduction partial or total of the contents by some process and on any support has to be authorized to a prior express approval of SelfTronic. All the information, the contents, the files and the software offered by our services are protected by the French and international laws concerning the intellectual property and the copyright. SelfTronic cannot give you the permission to copy, post or distribute any content for which you do not have intellectual property laws. Any use of these contents in fraud of the rights held by thirds on those is constitutive of the forgery offence, severely sanctioned by the Code of the Intellectual property. SelfTronic could not be responsible of the violation by a user of rights held by thirds and perpetrated t on the Website.
